Kim Zolciak Denies Losing Custody Amid Kroy Biermann's Sole Custody Bid
Kim Zolciak has publicly refuted allegations that she has lost custody of her four children with estranged husband Kroy Biermann. The former Real Housewives of Atlanta star, 47, took to Instagram Stories to address recent reports, vehemently denying claims that a Georgia judge ordered the minors to remain with their father until she completes court-mandated parent therapy sessions.
Biermann's Custody Filing and Court Developments
Earlier this week, Kroy Biermann, 40, filed for sole custody of their children: KJ, 14, Kash, 13, and twins Kaia and Kane, 12. According to court documents obtained by the Daily Mail, Biermann alleged that Zolciak has been flouting her parental responsibilities, including extensive international travel and failure to attend required counseling sessions. He described her actions as "blatant mismanagement of basic parenting responsibilities" and accused her of entering into their temporary custody agreement "in bad faith."
On Friday, TMZ reported that a Georgia judge told Zolciak the children must stay with Biermann until she finishes four parent therapy sessions. However, Zolciak immediately contested this narrative, sharing a screenshot of the report on Instagram and writing, "I will absolutely not put up with these lies any longer."
Zolciak's Defense and Explanation
In a lengthy social media post, Zolciak explained her side of the story. She acknowledged missing "required counseling sessions" but attributed this to international "contractual filming obligations" from February 26 through March 28. "During that time, I did not have a single day off, making it impossible to attend the required counseling sessions," she stated.
Zolciak emphasized that she signed a temporary custody order at the end of January, which stipulates that both parents participate in two counseling sessions per month for two months, followed by one session per month thereafter. She clarified that Biermann currently has the children for spring break, which is his designated parenting time under the existing agreement, and she is scheduled to resume her parenting time when they return on Friday.
"For the avoidance of any doubt, I have not lost custody of my children, nor has there been any modification to the custody agreement outside of the agreed upon temporary order," Zolciak asserted. She added that her counseling sessions "will be completed next week," after which she expects to reunite with her kids.
Biermann's Allegations and Legal Claims
Biermann's court filing includes serious accusations against Zolciak. He claimed that during her parenting time, she allowed their children to miss scheduled therapy sessions and failed to meet with her own therapist for the minimum required number of sessions. He also accused her of "lying to the therapists" and alleged "fraud and deceit" in pushing for the temporary joint custody agreement.
One particularly notable allegation involves an incident on March 9, when Biermann claimed Zolciak exercised her parenting time and one of their "minor children was subject to a dog bite." Biermann stated he is prepared to show through expert and witness testimony that Zolciak is "both unstable and unfit as a custodial parent" and asked the court to immediately award him sole custody.
Family Background and Broader Context
In addition to her four children with Biermann, Zolciak has two adult daughters from previous relationships: Brielle, 29, and Ariana, 24. Biermann adopted both daughters after marrying Zolciak in 2011. The former Atlanta Falcons linebacker and reality TV star have been separated since May 2023, with their divorce proceedings beginning in August 2023.
Zolciak responded to Biermann's allegations through a representative, telling the Daily Mail: "These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for – something I will never apologize for."
She added, "I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent, the truth is on my side, and it will come to light – no matter how hard anyone tries to bury it."
The latest developments follow a mediation session on January 27 where the exes attempted to sort out their temporary child custody agreement. According to TMZ, the earliest Zolciak can see her four youngest children is April 13, though she maintains this is simply part of the existing parenting schedule rather than a custody modification.
