The Western Cape High Court heard how eight-year-old Daniel Jamneck was raped and strangled to death by his friend's father during a sleepover in Cape Town on June 15, 2023. Daniel's friend was asleep on a bunk bed in the same room when the attack occurred.
Repeat Offender Sentenced
The attacker, who cannot be named to protect his son, was handed a life sentence for the rape and murder of Daniel. He also received a 10-year sentence for the rape of Caryn Brown, with the terms to run concurrently. The court heard that he was a repeat sex offender who had been allowed to remain free.
In addition to the prison terms, he was placed on the National Register for Sex Offenders, permanently barred from working with children, and prohibited from possessing a firearm.
Victim Impact
Daniel's mother, Maria Jamneck, described her son as "our absolute light" in her victim impact statement, adding that the trauma of the attack continues to affect her family every day. Both Ms Jamneck and Ms Brown were granted the right to make representations to the Parole Board should the attacker ever become eligible for release.
Juanita du Preez, a spokesperson for Action Society, a South African civil rights organisation, said: "Today's sentence brings justice for Daniel and recognises the immense suffering endured by Maria, Caren and everyone whose lives have been shattered by this monster." She added that the attacker had a prior rape conviction, had absconded from a court-ordered rehabilitation programme, and faced a subsequent attempted rape charge that was withdrawn before Daniel was killed.
Du Preez continued: "Justice has finally been served. But we will continue our fight to expose the failures within the criminal justice system that allowed this accused to remain free and continue his crime spree, ultimately ending in Daniel's death." She said South Africans deserve a justice system that identifies dangerous repeat offenders and acts decisively to protect innocent lives.
