Police have clarified the rules around undertaking middle lane drivers, with those caught outside permitted Highway Code exceptions risking a £100 fine and three points on their licence.

What the Highway Code says

Drivers who undertake lane-hoggers by overtaking on the left could face prosecution for careless driving, despite feeling justified in their actions. Rule 268 of the Highway Code states: “Do not overtake on the left or move to a lane on your left to overtake.”

However, there are specific exceptions where undertaking is permitted, including when traffic is moving slowly in queues and the right lane is moving slower than your lane.

Penalties and reporting

Police warn that while there's no specific offence of undertaking, drivers could be prosecuted for careless driving with penalties of £100 and three points on their licence. Drivers can also be reported through Operation Snap if caught on camera by other motorists submitting evidence to police forces.

The Highway Code allows undertaking “in congested conditions, where adjacent lanes of traffic are moving at similar speeds” and when vehicles are signalling to turn right.

Expert warning

Driving expert Big Jobber warns: “Two wrongs don't make a right. Passing on the left creates a hazard, it increases the risk of a collision and can be extremely dangerous and potentially fatal.”
